Litigating Major Automobile Injury and Death Cases

Ken Levinson to Teach at AAJ’s 2021 Depositions College

June 4, 2021 by Levinson and Stefani Leave a Comment

Throughout the month of June, the American Association for Justice is hosting its Depositions College workshop, referred to this year as the ‘Depositions College: Implementing the Tools’ webinar. On the faculty lineup this year is Levinson and Stefani’s very own Ken Levinson.

Starting today, the online workshop will run each Friday in June from 2:00 to 5:00 p.m. Eastern Time. During each session, participants will receive insight into a certain new deposition skill through lectures during four separate two-hour workshops, and then have the opportunity to unpack that knowledge with a faculty member in small groups.

There is a variety of new skills that will be focused upon during this month of workshops, including: dealing with difficult or evasive witnesses, techniques for deposing non-party damage witnesses, taking corporate 30(b)(6) depositions, and methods for deposing medical experts or DME.

Some other faculty members teaching at the event include Karen R. Roberts of Roberts & Roberts in Texas, Jason Penn of Berman, Sobin, Gross, Feldman, & Darby LLP in Maryland, Yvonne M. Flaherty of Lockridge Grindal Nauen PLLP in Minnesota, Thomas W., Dillon of Konicek & Dillon, PC in Geneva, Illinois, and Seth L. Cardeli of Levin & Perconti, also in Chicago.

Each day of the program will begin with a lecture on the day’s topic, followed by a presentation from a sponsor, a live question and answer session, and finally the small group workshop led by a faculty member. AAJ’s four-part webinar will be able to be credited for 12 hours of CLE credit.

Levinson and Stefani Help With Publication of New Edition of Auto Injury Case Litigation Book

January 9, 2021 by Levinson and Stefani Leave a Comment

The 2020-2021 Edition of Litigating Major Automobile Injury and Death Cases has just been released, and Levinson and Stefani have contributed to the book.

Litigating Major Automobile Injury and Death Cases is divided into two separate volumes and aims to give plaintiff attorneys proper guidance in regards to major automobile injury and death case representation. It also provides specific strategies for using the least expenditure of effort in order to win the largest damage awards as possible.

Volume 1 of the book, Law and Forms, explains how an attorney can build the best possible case by “incorporating litigation strategies that undermine expected defense strategies and affirm [the] case.”

Volume 2, Forensic Science, is medical reference-based and offers data regarding injury mechanism topics. These are meant to “prove causation and damages for a variety of crash types and crash injuries, including epidemiology, injury risk by crash type, injury pattern analysis, biomechanics, and more.”

Levinson and Stefani took the initiative to contribute a section written by Louisville-based attorney Jay Vaughn, who specializes in remote depositions. Vaughn was able to add guidance on this topic in an effort “to help practitioners during the pandemic working remotely,” which will also be “for use even when things get back to normal,” explained Ken Levinson.

In this particular contribution, Vaughn details certain technology basics, a ‘Best Practices’ checklist, court reporter instructions, the sharing and usage of exhibits, and deposition notice samples for Zoom.

The book also features tools such as focus group, trial consultant, and juror interview guidance; ways to construct the best visual aids and prepare effective presentations for a jury; procedures that give step-by-step guidance from a client’s first meeting all the way to a winning judgment; legal resource references for litigating a case to a favorable verdict; air bag, seat belt, and other auto safety-related technical articles; and scientific articles to help attorneys obtain expert and opposing expert critical testimonies.

PARTNER KEN LEVINSON AUTHORS LATEST EDITION OF LITIGATING MAJOR AUTOMOBILE INJURY AND DEATH CASES

CHICAGO — Levinson and Stefani founding partner Ken Levinson has co-authored the 2015-2016 edition of Litigating Major Automobile Injury and Death Cases, the newest volume of the reference litigation series published by AAJ Press/Thomson Reuters.

Part of an ongoing series, Litigating Major Automobile Injury and Death Cases is designed to help plaintiff’s attorneys build strong cases for their clients by highlighting real-life case studies related to Major Auto Injury and Death. The series features written discovery, depositions, medical and other expert witness testimony, and aspects of automobile jury trials, among dozens of other topics. The latest edition includes two high-profile cases that have dominated headlines in 2015, including:

  • The legal requirements of air bag installation and a recent case involving Takata airbag inflators, which, in some instances, ignited with explosive force, causing metal shards to spray across the vehicle. Reports showed that eight people have been killed and at least 160 have been injured by exploding Takata air bags with more than 70 proposed class action lawsuits and dozens more cases filed in state courts.
  • Ignition switch litigation due to negligent practices, most notably a recall of 10 million motor vehicles manufactured by General Motors that resulted in 114 deaths and 229 injuries. The overview contained here is intended to provide a basic understanding of the problems with the GM ignitions switches and GM’s knowledge of them, and to summarize the current state of litigation.

The two-volume series is co-authored by Thomas D’Amore, Karen Koehler, and Michael D. Freeman.
